1. SUPPORT & MAINTENANCE
Diploy (“brand”) managed & operated by BISHT TECHNOLOGIES PRIVATE LIMITED (“BTPL”) here bears full responsibility for the development of a client’s website/mobile app within the guideline of our Design & Development services. This includes the comprehensive development of a project from inception to completion. All support for clients from the envato marketplace or those referred by 3rd party websites will be in line with platform guidelines or the project agreement.
In this agreement, the terms “BTPL”, “we”, “us”, and “our” are used to refer to the Company whilst “you” refers to you as a website user.
2. CONTENT
We cannot be held responsible for any data residing on the client’s website or mobile app. The content remains the copyright and intellectual property of the Client. Diploy retains the right to use any graphics or other web design components as examples for our portfolio.
3. QUOTATIONS
The price quoted to the client only covers the work specified in the quotation. If the client requires changes during the development process, a separate quote for the additional work will be provided. Also, the timeline for completing the project may need to be revised.
4. UPFRONT PAYMENT
A 25% advance of the total project cost is necessary before work can commence. Once a team is assigned to your project, all payments become non-refundable.
5. PAYMENT TERMS
We currently accept payments through NEFT or Stripe unless a different arrangement is made.
6. PAYMENT
Invoices must be settled within 07 days. The full website/mobile app launch only takes place after full payment is received unless otherwise agreed. There will be a minimum charge of US$ 100 or 10% of the total project fee (whichever is higher) to restore any previously published/launched material/codes if payment is not received. Accounts unsettled within 07 days post-invoice will incur a late fee of 15% of the due amount. Please note that we only keep project backups for 30 working days.
7. CONTRACT
All client-supplied material remains the property of the client and we will consider it as being lawful and not breaching any copyright laws.
8. MATERIAL
We regularly partake in online advertising which displays our ads to you on third-party websites and apps.
9. DOMAIN NAMES
We offer domain name services if needed. Until the agreed professional fees and costs of booked domains have been paid by the client, the domain names remain the property of Diploy.
10. COPYRIGHT
Diploy retains the copyright of all material, including design, artwork, and source code created for the client. Once final payment is received, the copyright may transfer to the client if previously agreed. Unless otherwise agreed in writing, we retain the right to the copyright of all created material.
If a client has purchased one of our readymade products listed on our site or on any other sites like envato, codecanyon, etc., the client is only permitted to use the software for private or commercial purposes but cannot resell it in any form without Diploy’s consent.
11. REGISTRATION CHARGES
The client will be responsible for all third-party costs from the registration of a domain name or the purchase of third-party utilities/services. These charges must be paid to Diploy before a formal registration application is made, and they are included in the standard invoice issued after work approval.
11. PHOTOGRAPHY AND GRAPHICS
Diploy may utilise stock photographs and images in the website/app design and build. The client will bear the cost of images and graphics purchased from stock libraries and will only be included after the client approves the additional cost.
12. PROJECT DELIVERY TIME
It is Diploy’s responsibility to deliver the project according to the agreed timeline, provided that the client has submitted all requirements on time. However, no late-delivery penalties or implications can be held on Diploy in case of a delay for any reason.
13. TECHNICAL SUPPORT
Diploy provides technical support for their products or custom projects as mentioned on the product page or on the agreed terms from the date of project delivery. This Technical Support is available only for code-level bugs, assuming the client hasn’t made any alterations or changes within the source code.
14. REFUND
We offer a 100% refund if the project hasn’t been started before the client cancels it. However, once a team is assigned to your project, all payments become non-refundable.
15. SOURCE CODE
We provide 100% source code delivery to the client after project completion and payment due.
